Terms of service
These terms govern the use of PUBLIC.BUZZ, a service of BRAIN PAIN MUSIC GmbH, Bahnhofstrasse 6, 9201 Gossau SG (“we”). By creating an account you accept them.
1. The service
PUBLIC.BUZZ lets you create a link-in-bio page with your own address. Which features you can use depends on your plan (Free, Presence, Spotlight, Impact or Agency), as described on our pricing page.
2. Your account
- You must be at least 16 years old, or have the consent of a parent or guardian.
- Keep your password safe. You are responsible for everything that happens in your account.
- Your page address must not imitate other people, brands or organisations. We may change or withdraw addresses that do.
3. Your content
You keep all rights to the content you publish. You allow us to store and display it in order to provide the service. You are responsible for your content and must have the necessary rights to it. Content that is illegal, infringes the rights of others, is misleading, hateful, sexually explicit or used for spam, phishing or malware is not allowed. We may hide or remove such content and suspend accounts in serious or repeated cases.
4. Free trial, plans and payment
- New accounts can try Spotlight free for 7 days. No payment details are needed for the trial.
- Paid plans are billed in advance, monthly or yearly, in CHF through our payment provider Stripe. If value added tax applies, it is shown at checkout.
- Subscriptions renew automatically until cancelled.
- Prices may change. We will inform you at least 30 days in advance; changes apply from your next billing period.
5. Cancellation and downgrade
You can cancel at any time in your account. Your plan stays active until the end of the period you have paid for; payments already made are not refunded unless required by law. Afterwards your page continues on the Free plan. Nothing is deleted: your content and design are kept, and paid features become available again if you upgrade.
6. Deleting your account
You can delete your account at any time in your dashboard. Your page, links and images are then deleted immediately and cannot be restored. We may close accounts that break these terms, and inactive free accounts after advance notice by email.
7. Third-party services
Some features connect to other services (e.g. Spotify, YouTube, Calendly, Bandsintown). Their own terms apply, and you may need an account with them. We are not responsible for their availability or changes to their offers.
8. Availability
We aim to keep PUBLIC.BUZZ available at all times but cannot guarantee uninterrupted operation. Maintenance and updates may cause short interruptions.
9. Liability
We are liable for damage caused intentionally or through gross negligence. To the extent permitted by law, any further liability is excluded, in particular for indirect damage, lost profit and lost data. Please keep your own copies of important content.
10. Changes to these terms
We may update these terms. We will inform you of important changes by email at least 30 days in advance. If you do not agree, you can cancel before the changes take effect.
11. Applicable law and jurisdiction
Swiss law applies. The place of jurisdiction is St. Gallen, Switzerland, unless mandatory consumer protection rules provide otherwise.
